the bay bridge -- even befo we have exclusive information about the grand opening of the new eastern span of the bay bridge. even before the official vote tomorrow. >> it's happened again. a cyclist kill d ed by a truck making a right turn. tonight we ask who has the right-of-way? >> and your favorite lunch spot may not be where you expect it find it. a crackdown on food trucks that may force them to keep on moving. good evening. it's not supposed to be announced until tomorrow. but we have exclusive information tonight about when the new eastern span of the bay bridge will open. kpix 5's kristen aires. >> reporter: it will open on labor day. that information is coming from top transportation officials exclusively to us tonight. the vote tomorrow is

essentially a formality, they say. the bridge is expected to open on labor day. >> reporter: the decision to open the new bay bridge over the labor day weekend is expected to be formalized in a public vote tomorrow morning by these men, the heads of the bay area toll authority, caltrans, and the state transportation commission. the governor has already thrown his support behind the labor day opening after a federal report and a series of independent reviews deemed the new eastern span safe enough to open with a temporary fix of 32 busted bolts. now it will be a mad dash to pull the opening off. crews are expected to shut the bridge down for five full days as they scramble to pave it and paint it. there is demolition work still to be done. caltrans has told us their crews are up for it. >> in a sick kind of way, people thrive on being stressed to do a great job and the challenges of doing it are

actually exciting. >> reporter: we've learned there will be a modest ceremony celebrating the opening of the bridge. but nothing like the fanfare previously planned, the bike ride, the marathon. down the road, we may see a larger public ceremony to celebrate this. >> hard to believe, 24 years. the old one, it's going to take a while to get it down. >> reporter: crews are going to have to dismantle it in reverse. that could take 5-7 years, we're told. the city of san francisco will soon start going after food trucks in the financial district. truck owners will have to play by the same parking rules like everyone else on wheels. >> reporter: it's lunchtime!

the streets packed. for one kind of vehicle, it doesn't seem to be a problem. food trucks do brisk business with no apparent worries about the meter maid. we found them in yellow zones, red zones, even some parked in the middle of construction zones for 3-4 hours at a time. yet food truck regulations issued by the san francisco department of public works clearly state that all applicable parking regulations shall be observed. so what's going on? we put the question to the department spokeswoman. >> we don't look at them for you can only park in this specific parking space or two parking spaces, which a lot of the trucks take up. we give them a general location of the area. >> reporter: where in downtown san francisco can you ever park for 3-4 hours at a time? >> i don't mean to punt this, but that's for the municipal transportation agency to answer. >> reporter: paul rose with the agency didn't have an answer either. >> it has been a challenge to

enforce these rules on food trucks. >> reporter: he says his department has not been ticketing because the trucks have permits. but new regulations that just became law last month will mean a crackdown. >> at a yellow zone, you'll have to follow those time limits. you could get a citation if you go beyond that. >> reporter: not good news for trucks like this one in a yellow zone. even though they are a permitted truck, the meter says you're only allowed to park here four hours on sunday, and one hour the other six days of the week. but the meter reads well over an hour. >> you know they're going to start ticketing you guys? >> i heard about it. >> reporter: bri an says company is going by the book. >> our permits trump whatever regulation that is for the meter. >> reporter: a few blocks away, the same story. this truck was parked at a broken meter. >> very clear that i have a permit to park in this spot from 6:00 am to 10:00 am on tuesdays and thursdays only.

>> the city says it plans to iron out all the details in a couple weeks. there may be special exemptions to park longer at general meters. but the yellow zones will definitely be out. and most food trucks downtown do park in yellow zones. if you have a g-mail account, other eyes could be glancing through your e-mail. google has admitted it doesn't have to respect your privacy. >> reporter: at first it looks like a stunning admission from google. back in june, the company filed court documents in a gmail lawsuit. on page 28, it says "a person has no legitimate expectation of privacy in information he voluntarily turns over to third parties." google was actually quoting a supreme court case to make their legal point. >> i honestly think that people were just really surprised to see in black and white a legal brief that said you have no expectation of privacy. that's a phrase that is very inflammatory, and it made people feel a little uncomfortable.

>> reporter: cnet's molly wood says it's a stark reminder that web-based e-mail's primary job is to scan your e-mail and deliver ads. >> is this a fact of life about any other free web mail service you're going to use. these are all businesses. and their business is not to give you free e-mail. >> you don't scan it, crawl it and sell it? >> nope. >> reporter: one option is to get your own private e-mail service. starting at $15 a month, it can add up quickly over time. >> i can pay a little bit but have the peace of mind that it's private and secure, and i don't have to really worry about exposing my e-mails between myself and my clients to this third party search engine that's giving me free e-mail. >> reporter: and google released a statement saying they care and take very seriously

users' security and privacy. and all the features they've built into gmail apply to everyone, e-mails from or to a gmail account. >> what was the original privacy lawsuit about then? >> reporter: that was a class action lawsuit against data mining in gmail. people who don't have gmail, when they send an e-mail to google, they don't want their e-mail processed or scanned by google. google says they have every right to. they'll be back on court september 5th. it's easy to dismiss turmoil in the middle east as nothing new. but there is new concern that egypt will be a dangerous mess for years to come. egyptian security forces moved against two camps, filled with supporters of the democratically elected president, mohammed morsi, who the military ousted. when the

house on wigeon way in suis city. inside -- 485 plants a ne and a million dollar pot bust. authorities were tipped off to a house, inside 485 plants with a street value of nearly $1.5 million. police also confiscated 15 ounces of processed pot. the house has been declared unlivable. in another silicon company, more big cuts. cisco is cutting about 4,000 jobs. that's about 5% of its workforce. its earnings and revenue grew in the latest quarter, but it didn't measure up to wall street's expectations. cisco shares tumbled 9% in after-hours trading. more and more people are

illegally dumping garbage on the streets of oakland. >> reporter: caught in the act. a neighbor recorded these men dumping furniture, mattresses, and other trash onto a sidewalk. they unloaded the u-haul truck in broad daylight. neighbors monique and jana are familiar with the problem. they have been calling the city to pick up this large pile of garbage left in front of their building for a a week. >> this is just filthy. >> it's dis respectful. i would describe it as very disrespectful, very nasty, and not welcoming. >> reporter: oakland has one of the worst illegal dumping problems in the bay area. in 2011, it spent $3.2 million just to clean up after illegal dumpers. the city recently dedicated a team of lawyers just

out of law school to go after the offenders. and within a month, they caught and cited a dozen people using videos and pictures that show the offenders' license plates. >> many of these people aren't even living in oakland. they're coming here, bringing their trash, and dumping it on oad. the citypeople to report ve this one here causing a mobile app called see, click, fix. you snap a photo, you send it in, and they'll fix it. making it easier to reporter the violators and going after them will cut down on illegal dumping, but it won't stop the problem. >> where there's a will there's a way. >> reporter: as for these people, the city tracked them down using their plates. they were fined $8,000. >> the city attorney will ask the council next month to

friday, saturday, and sunday. upper 80s for walnut creek and concord. san ramon, pleasanton, 89 degrees. in the city, 67 degrees. alameda 71, petaluma, 81. cooler on friday. nice over the weekend . mid-80s inland, around 70 near the bay. cloud cover in the morning, then we warm back up next week. just subtle change, staying really close to normal. good stuff. >> beautiful. just a couple of hours ago, another crash between a car and a bike rider in san francisco. many of these accidents happen when cars make right turns. what is the law? what should car drivers do? what should bike riders do? >> reporter: this is really quite tragic. it happened again also earlier this morning. a cyclist was killed when a big rig riding alongside her slammed

into her. this is the bike lane that you see all around the city. the bicyclists are going straight. right next to it is the right-hand lane. when they get to a corner, the vehicles are turning right from that lane instead of getting closer to the curb. therefore there's a collision. >> reporter: they were both heading south on polk when the driver slammed into the cyclist. who has the right-of-way? >> the bicyclists are required to obey the same laws in traffic as vehicles are. so it really depends on the situation and the traffic pattern. if the bicycle is behind the car, the bicyclist can't go past the car until it's safe to do so or it's an unsafe pass. >> reporter: the bicycle coalition teaches road safety

for cyclists and drivers. the picture on the left shows the car is too far over from the curb making the turn. the picture on the right shows how close the car should be to the curb, and the cyclist should go around to the left. it's a rule many drivers and cyclists don't follow. >> it's scary. you got to be defensive when you're on a bike. you don't have much protection. >> sometimes you are in a place where a car don't see you. so they jump the curb. and you have to be careful. >> reporter: a bicycle coalition member rode through city streets with our camera strapped to her helmet. this shows how dangerously close it is for cars and cyclists. >> we really teach the person riding that they need to stay out of the blind spot, whether that's a bus or a large truck especially or any vehicle. you need to make sure you understand there are blind spots. so we make sure people don't try to squeeze between the vehicle and the curb. >> reporter: police tell me

that often the rule is that the first person in the intersection has the right-of-way. and psyche lifts and cars -- cyclists and cars follow the same rules of the road. a san francisco cyclist who pleaded guilty to felony manslaughter charges for running over and killing a man will be conscienced tomorrow -- sentenced tomorrow. he hit a 71-year-old man crossing castro last march. the man died four days later. tomorrow a judge could reduce the conviction to a misdemeanor. ,,,,,,,,,,,,,, goodnight.
